2 LAW No 363/2006 of 21/09/2006 published in the Romanian Monitorul Oficial, Part I, No 806/ 26/09/2006 on the approval of the Spatial Planning of the National Territory Section I Transport Networks The Parliament of Romania has passed this Law. Article 1. - (1) The Spatial Planning of the National Territory Section I Transport Networks, including the development works of the national transport infrastructure, as provided for in Annexes 1 to 10, has been approved. (2) The development works which make the object of this Law are of national interest and are public utility matters. Article 2. The meanings of the main terms used in this Law are given in Annex 11. Article 3. (1) The works stipulated in the Spatial Planning of the National Territory Section I Transport Networks, shall be included in the investment annex lists to the budgets of the main credit releasing authorities, based on the feasibility studies prepared and approved under the provisions of the legislation in force. (2) The works may be financed, either totally or partially, from the amounts levied every year for such purpose from the state budget through the budget of the Ministry of Transport, Construction and Tourism, external credits, unredeemable external credits and other legally formed financial sources, based on technical and economic documentation approved according to the legislation in force. (3) The execution of new works, regarded as top priority, but not included in the guidelines provided for by this Law, shall be approved following a governmental decision. (4) The execution schemes of the development works stipulated in this Law, under the project approved in comply with the current regulations shall be set up following a governmental decision. Article 4. (1) The provisions of the Spatial Planning of the National Territory Section I Transport Networks are mandatory and shall be applied to the spatial planning of counties, municipalities, towns or communes, as appropriate. (2) The definition of the lands, corridors and locations of the transport networks shall be made by urban and/or spatial planning documents and feasibility studies, approved under the current legislation. (3) Expropriation for public utility matter, land occupation and conversion from agricultural and forestry production shall be made pursuant to the provisions of the current legislation. (4) Permission for permanent constructions on lands reserved in spatial planning documents for the development of transport networks, as provided for in Article 1, shall be denied, unless an approval by the specialized body of the central public administration, laying down the policy in the area of transport networks, has been given. Article 5. The central, county and local public administration authorities shall co-operate to ensure enforcement of the provisions of this Law. Article 6. As of the date of enforcement of this Law, the Law No. 71/1996 on the Approval of the Spatial Planning of the National Territory Section I Communication Ways, published in the Romanian Monitorul Oficial, Part I, No. 166/ 29 July 1996, shall be repealed. Article 7. Annexes 1 10 shall be part of this Law. This Law has been approved by the Parliament of Romania, pursuant to the provisions of Articles 75 and 76 (1) of the Constitution of Romania, republished. 17 DEFINITIONS of the main terms used For the enactment of this Law the meaning of the terms and phrases below shall be as follows: 1. national road - it is the road in public property of the state of national interest, which links the capital city with the county capitals, the national strategic developments, and among them, and with the neighbouring countries. National roads can be: - motorways; - expressways; - European national roads; - main national roads; - secondary national roads. 2. highway - It is the high-speed national road designed to carry a large volume of traffic and for the exclusive vehicular travel, which does not service riparian properties, being a dual-carriageway road separated by a median area and including at least two traffic lanes in each direction and one lane for emergency stops, grade-separated junctions and limited access, the entrance and exit of motor cars being allowed in specially developed areas; 3. expressway - It is the national road accessible through interchanges or at-grade intersections, particularly designed for vehicular travel outside settlements and where lay-by and stay on the carriageway are forbidden; 4. four-lane road - It is a national road with four lanes accessible through at-grade intersections, whose way can cross settlements and where lay-by and stay on the carriageway are forbidden; 5. interoperable railway infrastructure 6. non-interoperable railway infrastructure 7. conventional railway lines - part of the state railway infrastructure, public or private, corresponding to national and international traffic, managed according to the provisions of the law on the free access of the railway transport undertakings, and which is developed in compliance with the technical specifications on interoperability adopted at European level and transposed in the Romanian legislation. - part of the state railway infrastructure, public, or private, corresponding to local railway traffic, connected or not to the interoperable infrastructure and which is administered and developed on the grounds of specific internal regulations. - railway lines allowing speeds lower than 200km/h; 17
18 8. combined transport network 9. inter-modal combined transport terminal facility - an international combined transport network consisting of railway lines and combined transport terminals, border crossing points, track gauge change stations and ports or ferryboat links of particular importance for international combined transport; - a facility equipped for the transshipment and storage of ITUs (Inter-modal Transport Units); 10. border crossing posts 11. the multi-modal Pan-European Transport Corridor IV 12. Pan-European Transport Corridor VII 13. the Inter-modal Pan-European Transport Corridor IX - any border station organized and authorized by the Government of Romania for state border crossing - Dresda / Nurenberg Praga Vienna/ Bratislava Budapest - Arad Bucharest - Constanţa / Craiova Sofia Salonic / Plovdiv Instanbul is the road and rail transport route and the link to water, air, sea and combined transport, including auxiliary installations such as: signaling, traffic control, haul roads, border crossing posts, servicing stations, freight and passenger terminals, warehouses developed along the transport corridor; - the Danube waterway, the Danube Black Sea Canal, the Chilia and Sulina branches of the Danube waterway, the navigable links between the Black Sea and the Danube, the Danube Sava Canal, the Danube Tisa Canal and the important port infrastructure along these waterways; - Helsinki St. Petersburg Moscow / Pscov Vitebsk Kiev Ljubasvika Chisnau Bucharest Dimitrovgrad is the road and rail route and the combined transport infrastructure, including auxiliary facilities such as: haul roads, border crossing posts, servicing stations, freight and passenger terminals, warehouses and necessary equipment for traffic control along the corridor route, as well as their links with the infrastructure junctions along the transport corridor; 14.
